The meeting was called to order at 7:08 PM, Commissioner Ron Austin, Chair (and ANC 4B06) presiding. It was held at the MPD’s 4th District Community Room, 6001 Georgia Avenue, NW. Also present were Commissioners 4B01 Andre Carley, 4B02 Frank Jones III, 4B03 Scot Knickerbocker, 4B04 Brenda Parks, 4B05 Brenda Speaks, 4B07 Judi Jones, 4B08 Barbara Rogers, and 4B09 Douglass Sloan. A quorum was present for all votes.


2) Election of Officers


Commissioner Austin announced the election of officers and asked Jim Irwin, ANC 4B Office Manager, to conduct the election.


Commissioner Sloan nominated Commissioner Austin was nominated for Chair. There were no other nominations.


Commissioner Austin was elected unanimously as Chair.


Commissioner Austin nominated Commissioner Sloan for Vice-Chair. There were no other nominations.


Commissioner Sloan was elected unanimously as Vice-Chair.


Commissioner Rogers nominated Commissioner Judi Jones for Secretary. There were no other nominations.


Commissioner Judi Jones was elected unanimously as Secretary.


Commissioner Parks nominated Commissioner Rogers as Treasurer. There were no other nominations.


Commissioner Rogers was elected unanimously as Treasurer.


3) Election of Walter Reed Citizens Advisory Committee Representative


Commissioner Parks nominated Commissioner Speaks as ANC 4B representative on the Walter Reed Citizens Advisory Committee. There were no other nominations.


Commissioner Speaks was elected unanimously as Walter Reed Citizens Advisory Committee Representative.


4) Approval of the Agenda


Commissioner Judi Jones moved to amend the agenda to postpone consideration of the Engine 22 building design and the Takoma Theatre exterior design to the February 22 public meeting. Commissioner Speaks seconded the motion. The motion was adopted 8 yes, 0 no.


Commissioner Sloan moved to approve the agenda as amended. The motion was approved, 8 yes, 0 no.


5) Resolution 4B-16-0101 Approving ANC 4B 2016 Meeting Dates


Commissioner Frank Jones moved that the Commission adopt a resolution setting meeting dates for 2016. Commissioner Judi Jones seconded the motion. The motion was adopted 7 yes, 0 no.

That Advisory Neighborhood Commission 4B hereby adopts the following meeting schedule for the year 2016:


The fourth Monday of the month, in the community meeting room, MPD Fourth District Headquarters, 6001 Georgia Avenue N.W., beginning at 7:00 PM, except the months of July, August and December:

6) Resolution 4B-16-0102 Authorizing Participation In 2016 ANC Security Fund


Commissioner Frank Jones moved that the Commission adopt a resolution announcing approving participation in the ANC Security Fund for 2016 and authorizing payment of the $25.00 fee.. Commissioner Judi Jones seconded the motion. The motion was adopted unanimously 7 yes, 0 no.


4) Resolution 4B-16-0104 Recommendations to BZA re application for special exception to allow fast food establishments– Ft Totten Square

Commissioner Judi Jones moved that the Commission adopt a resolution supporting an application to the Board of Zoning Adjustment for a special exception at Ft. Totten Square to allow fast food establishments. Commissioner Rogers seconded the motion. The motion was adopted unanimously 7 yes, 0 no.

Advisory Neighborhood Commission 4B (the Commission) takes note of the following:





  1. Is the proposal in harmony with the general purpose and intent of the Zoning Regulations and Zoning Map?

  2. Would the proposal tend to affect adversely, the use of neighboring property? (11 DCMR§3104.1)




RESOLVED:


That Advisory Neighborhood Commission 4B does not object to the relief sought, but recommends that the applicant be asked to agree to the following conditions:


  1. The Applicant agrees to sponsor a neighborhood retail and amenities needs survey in the following manner: (a) the creation and maintenance of an online survey account, within six weeks of the submission of this resolution to BZA; and (b) the subsequent printing and distribution of the survey and any notifications about the survey and to submit said materials to ANC 4B.


  1. The Applicant and its brokers agree to engage in regular and meaningful collaboration with community stakeholders about general retail strategy to ensure that the Small Area Plan is effectively implemented.


  1. The Applicant makes its best effort to secure a quality sit-down restaurant tenant as envisioned by the residents in the Lamond Riggs community.


FURTHER RESOLVED, that the Commission designates Commissioners Douglass Sloan, ANC 4B09 and Barbara Rogers ANC 4B08 to represent the Commission in all matters relating to this resolution.


FURTHER RESOLVED, that, in the event that either or both designated representative Commissioners cannot carry out their representative duties for any reason, the Commission authorizes the Chairperson to designate another Commissioner to represent the Commission in all matter relating to this resolution.


FURTHER RESOLVED, that consistent with DC Code §1-309, only actions of the full Commission voting in a properly noticed public meeting have standing and carry great weight. The actions, positions and opinions of individual commissioners, insofar as they may be contradictory to or otherwise inconsistent with the expressed position of the full Commission in a properly adopted resolution or letter, have no standing and cannot be considered as in any way associated with the Commission.


5) Resolution 4B-16-0107 -- ABRA 101229, Taco-Ma, 353 Cedar St NW – Application for Retailers Class C liquor license


Commissioner Austin moved to protest the liquor license application of Taco-Ma, located at 353 Cedar Street NW. Commissioner Knickerbocker seconded the motion. The motion was adopted, 6 yes, 0 no, 1 abstain.

RESOLVED:


That Advisory Neighborhood Commission 4B protests the application of Taco-Ma Yucatan Chicken, 353 Cedar Street N.W., ABRA-101229 for a Retailer’s Class C Restaurant liquor license on the basis of concerns related to peace, order, quiet and parking.


FURTHER RESOLVED, that the Commission designates Commissioner Andre Carley, ANC 4B01 to represent the Commission in all matters relating to this resolution.


FURTHER RESOLVED, that, in the event the designated representative Commissioner cannot carry out his representative duties for any reason, the Commission authorizes the Chairperson to designate another Commissioner to represent the Commission in all matter relating to this resolution.


FURTHER RESOLVED, that consistent with DC Code §1-309, only actions of the full Commission voting in a properly noticed public meeting have standing and carry great weight. Community Concerns



: The following people addressed the Commission with concerns:


1) Ms. Wanda Oates, 4B05, congratulated officers on their election and commended the Commission for the professional way in which it had conducted its business in 2015.


2) .Ms. Takita Mason, Paul Public Charter School, informed the Commission that they are amending their charter to provide that the school becomes independent from DC Public Schools for all special education related matters.


3) Minister. Chi Mauuso, 4B03, thanked various DC government agencies for their assistance with various matters.


4) Ms. Jocelyn Johnson, 4B03, thanked Commissioner Knickerbocker for being out checking on residents, including her, during the recent blizzard. She complained that the District government handled the blizzard and snow removal very badly.

1) Ms. Sara Green, Chair, ANC 4B Design Review Committee, presented the committee’s report and recommendations on the Engine 22 Building Design.
